Without seeing the actual document, one can only hazard an educated guess, so mine would be to ensure that the Table of Contents text included in the TOC itself is formatted with a style other than the heading styles used in the TOC. The style can be similarly formatted to the Heading style already used. You can still number the Table of Contents paragraph if you wish and start the heading style numbers from 2.
