By default, a TOC field picks up anything created in Heading Style 1-3. If your TOC is configured for more Heading Styles (up to 9) or less, or for other Styles besides these, it will always revert to whatever it is configured for every time it is refreshed.
Your problem description suggests you are trying to build a Table of Contents partially from content for which the TOC field has not been configured.
