Office 2016 Surface Pro 4 Pen/Inking issue

I have a problem with Pen/Inking in Office 2016 on the Surface Pro 4



Open Word or Excel and start inking with Pen do not close this document an open a new document and the pen/inking feature does not function. Close the second document and go back to the original document you can still use the inking feature.

Close the original document without exiting Word and open a new document and Pen/Inking feature does not function.

Close the program and restart and the feature returns but only for the first document once again?

Have gone to BestBuy and tried on other Surface products and experienced the same issue. Contacted Microsoft they sent a replacement Surface that did not solve the issue now they have blown me off until Monday when a software engineer is supposed to contact me.
