It appears your '2.1' & '3.1' paragraphs are formatted in Word's 'Heading 2' Style. Not an especially good idea, but manageable by changing the TOC settings.
By default, Word TOCs incorporate heading Styles 1-3. When creating the TOC, you can limit this to, say, 'Heading 1'. Alternatively, you can edit the TOC field later on, by adding the appropriate switches. For the latter, select the TOC field and press Shift-F9. You should see something like '{TOC}' or '{TOC \o "1-3" \h \z}'. Change the code so that you have something like '{TOC \o "1-1"}' or '{TOC \o "1-1" \h \z}'. Whn you're done, press Ctrl-A, then F9 to update the TOC.
